Regulation Authority:

§31-47.4-2 and Chapter 42-35 of the General Laws of Rhode Island, as amended.

Purpose and Reason:

The Department of Revenue’s Division of Motor Vehicles proposes to adopt regulations for the purpose of describing the practices and procedures of the Division of Motor Vehicles as relates to the use and administration of the Insurance Verification Program for the purpose of administering and enforcing chapter 31-47.4 of the Rhode Island General Laws. The regulations set forth the duties of insurance companies and the DMV in transmitting data to a third party vendor for purposes of verifying active insurance for vehicles actively registered in RI. These set forth the security protocols and time schedule for transmission of data, as well as consequences for failing to provide data as required by statute. The regulations further establish the notification process used if a motorist does not appear to have insurance and what the motorist may do to rectify that situation. Due process procedures are also included addressing motorists whose registrations may be subject to revocation. Substantive changes between the proposed and final rules include the following: Amend 2.9 "Insurer" the word "and" was replaced with "or", add 2.15 definition of "Revocation Proceedings", add 4.8 "Data Breach", and add language in 6.1 to include date of revocation on the notice.
